Terms and Conditions

Participation in this BIG SCREEN MOMENT (this "Promotion") is governed by these Terms and Conditions (“Terms”).

The "Promoter" of this Promotion is TCL electronics MEA DMCC,2005-2006, BB2, MAZAYA Tower JLT, Dubai, UAE. References to the "Promoter" shall include all of the Promoters associated companies involved in this Promotion.

By entering the Promotion, the participant as hereinafter defined under Clause 1 of these Terms (“Participant(s)”) fully accepts the provisions of present Terms.

1. ELIGIBILITY

(1) The Promotion is only open to all residents in the Dubai, United Arab Emirates of legal age, except:

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Promotion or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

(“Participants”)

(2) In entering the Promotion, Participants confirm that they are eligible to do so and eligible to claim the prize OR any prize they may win. The Promoter may require Participants to provide proof that they are eligible to enter the Promotion. Any inability to provide the proof when requested may disqualify Participants from the Promotion and/or withhold the prize.

(3) The Promoter will not accept promotion entries that are:

(d) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);

(e) completed by third parties or in bulk;

(f) illegible, have been altered, reconstructed, forged or tampered with;

(g) photocopies and not originals; or

(h) incomplete.

(4) There is a limit of one entry to the Promotion per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

(5) The Promoter reserves all rights to disqualify Participants if their conduct is contrary to the spirit or intention of the Promotion.

(6) Promotion entries cannot be returned.

2.  RULES OF THE PROMOTION

(1) Promotional Period. The Promotion will run from 10:00 (GMT+3) on January 7 (the "Opening Date") to 23:59 (GMT+4) on January 31, 2025 (the "Closing Date") inclusive.

(2) Participation Criteria. To enter the Promotion, Participants shall:

(a). Share a 15+ sec video or photos highlighting why you LOVE your TCL Big Screen TV – post to your Instagram grid or story on the social media.

(b). Use #choosetcl in you posts and tag@ us

Please note that:

a. There is no purchase or payment requirement to participate in this Promotion.

b. the Promotion is in no way sponsored, endorsed or administered by, or associated with the social media platform.

c. Participants shall ensure that they have not entered into any agreements with third parties that could impair the Promoter's rights to use their entries.

d. The use of product reviews, photos or videos published by others on public media will not be accepted.

e. All Promotion entries received after the Closing Date are automatically disqualified.

f. After the Closing Date, all submissions will be reviewed for eligibility.

3.  Prizes

(1) The prizes for this Promotion event are as follows:

Please note:

a. The Prizes are not redeemable in cash or other Prizes, in whole or in part. Prizes are non-transferable, non-exchangeable, and non-sellable. The Promoter may, at its sole discretion, substitute any Prize won with a prize of equal or greater value.

b. However, in the event that the Prize is unavailable due to circumstances beyond Promoter’s control, and the Promoter has used all reasonable efforts to arrange the Prize, to the maximum extent permitted by law, it reserves the right to offer a substitute prize of equal value to the original Prize, subject to any directions from a regulatory authority.

 

4. Claiming the prize

(1) One winner for the TV will be chosen with the most votes via Instagram Story poll on 30th January and notified by DM. Amazon Gift Card winners are selected by a random drawing system created by Promoter, without any pre-defined criterion. For the avoidance of doubt, the Winners shall not be entitled to a choice of Prize. The list of winners will be announced on TCL official account after the campaign.

(2) The winner must respond within seven (7) days to claim this prize. The prize may not be claimed by a third party on your behalf.

(3) The lack of response in the time and/or the lack of identity accreditation will lose the right to claim the Prize and an alternate winner will be selected.

(4) The Promoter does not accept any responsibility if winners are not able to take up the Prize.

 

5. SUBMISSION AUTHORIZATION

(1) Participants must have independent, full, clear, and undisputed intellectual property rights of their entries. Participants should ensure that their entries are independently authored and their entries do not infringe the rights of third parties, including copyright, portrait rights, reputation, privacy, etc. Plagiarism is strictly prohibited. If discovered, the entries will be disqualified. All legal responsibilities arising from the above guarantee are the responsibility of the Participants and have nothing to do with the Promotion platform and the Promoter.

(2) By entering the Promotion, to the maximum extent permitted by law, Participants agree to grant the Promoter and its affiliates a non-exclusive, worldwide, irrevocable licence in perpetuity, for the full period of the intellectual property rights in the Promotion entries, to use, display, publish, transmit, copy, edit, alter, store, re-format and sublicence the intellectual property rights in their Promotion entries free of charge, including but not limited to the use of the entries for online media, print media, printed materials, exhibitions, retail stores, roadshows, etc. The Promoter and its affiliates, TCL, etc. are not required to notify the Participant or obtain the Participant’s consent to such use. 

 

6. DISCLAIMER AND LIABILITY LIMITATION

(1) THE PROMOTER ACCEPTS NO RESPONSIBILITY FOR ANY LATE, LOST, DELAYED, INCOMPLETE, INCORRECTLY SUBMITTED, CORRUPTED, ILLEGIBLE OR MISDIRECTED ENTRIES, CLAIMS OR CORRESPONDENCE WHETHER DUE TO OMISSION, ERROR, ALTERATION, TAMPERING, DELETION, THEFT, DESTRUCTION, DISRUPTION TO ANY COMMUNICATION NETWORK OR MEDIUM, OR OTHERWISE INCLUDING THOSE ENTRIES NOT RECEIVED BY THE PROMOTER FOR ANY REASON. THE PROMOTER IS NOT LIABLE FOR ANY CONSEQUENCES OF USER ERROR INCLUDING (WITHOUT LIMITATION) COSTS INCURRED.

(2) IN THE CASE OF THE INTERVENTION OF ANY OUTSIDE ACT, AGENT OR EVENT WHICH PREVENTS OR SIGNIFICANTLY HINDERS THE PROMOTER'S ABILITY (OR THAT OF A THIRD PARTY INVOLVED WITH THE PROMOTION) TO PROCEED WITH THE PROMOTION ON THE DATES AND IN THE MANNER DESCRIBED IN THESE TERMS OF ENTRY, INCLUDING BUT NOT LIMITED TO VANDALISM, NATURAL DISASTERS, ACTS OF GOD, CIVIL UNREST, STRIKE, WAR, ACT OF TERRORISM, THE PROMOTER'S OBLIGATIONS IN RESPECT OF THE PROMOTION WILL BE SUSPENDED FOR THE DURATION OF THE EVENT AND, IN ADDITION, THE PROMOTER MAY IN ITS ABSOLUTE DISCRETION CANCEL THE PROMOTION AND RECOMMENCE IT FROM THE START ON THE SAME CONDITIONS, SUBJECT TO APPROVAL OF THE RELEVANT AUTHORITIES.

(3) THE PROMOTER TAKES NO RESPONSIBILITY WHERE IT IS UNABLE TO CONTACT PRIZE WINNERS WHO HAVE NOT PROVIDED CORRECT OR COMPLETE CONTACT DETAILS. IF A PARTICIPANT'S CONTACT DETAILS CHANGE DURING THE PROMOTIONAL PERIOD, IT IS THE PARTICIPANT'S RESPONSIBILITY TO NOTIFY THE PROMOTER. A REQUEST TO MODIFY ANY ENTRY INFORMATION SHOULD BE DIRECTED TO THE PROMOTER.

(4) TO THE GREATEST EXTENT PERMITTED BY LAW, THE PROMOTER EXCLUDES ALL WARRANTIES, REPRESENTATIONS OR GUARANTEES (WARRANTIES) REGARDING THE PROMOTION AND ANY PRIZES. THE CONDUCT OF THE PROMOTION OR THE SUPPLY OF PRIZES MAY INVOLVE THIRD PARTIES, AND THE PROMOTER MAKES NO WARRANTIES AND DISCLAIMS ALL LIABILITY IN CONNECTION WITH ANY SUCH THIRD PARTIES, THEIR ACTS OR OMISSIONS. BY ENTERING THE PROMOTION, A PARTICIPANT RELEASES AND INDEMNIFIES THE PROMOTER AND ITS RELATED BODIES CORPORATE (INCLUDING THE OFFICERS, EMPLOYEES, TCL AND AGENTS OF EACH) FROM AND AGAINST ALL ACTIONS, PENALTIES, LIABILITIES, CLAIMS OR DEMANDS THE PARTICIPANT MAY HAVE AGAINST THE PROMOTER OR THAT THE PROMOTER MAY INCUR FOR ANY LOSS OR DAMAGE WHICH IS OR MAY BE SUFFERED OR SUSTAINED AS A DIRECT OR INDIRECT RESULT OF AN PARTICIPANT ENTERING OR PARTICIPATING IN THE PROMOTION OR WINNING OR FAILING TO WIN A PRIZE, OR USING OR PERMITTING ANY OTHER PERSON TO USE THE PRIZE, EXCEPT FOR ANY LIABILITY WHICH CANNOT BE EXCLUDED BY LAW OR WHICH WOULD CAUSE ANY PART OF THIS CLAUSE TO BE VOID OR UNENFORCEABLE.

(5) WITHOUT LIMITING ANY OF THE FOREGOING, IN NO CIRCUMSTANCES WILL A PARTICIPANT OR THE PROMOTER HAVE ANY LIABILITY TO THE OTHER FOR ANY LOSS OR DAMAGE SUFFERED WHICH IS INDIRECT OR CONSEQUENTIAL IN NATURE, INCLUDING WITHOUT LIMITATION ANY LOSS OF PROFIT, LOSS OF REPUTATION, LOSS OF GOODWILL, OR LOSS OF BUSINESS OPPORTUNITY.

(6) AMENDMENT: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROMOTER RESERVES THE RIGHT TO CHANGE THESE RULES OR CANCEL THE PROMOTION AT ANY TIME, IN ITS SOLE DISCRETION.

 

7. STANDARDS OF CONDUCT

Promoter shall have the right to refuse any participation which includes or suggests any of the following:

a) unlawful, harmful, offensive, threatening, abusive, harassing, invasive of privacy or publicity rights, defamatory, libellous, vulgar, obscene, pornographic, indecent, lewd, suggestive, scantily-clad, profane, hateful, racially, ethnically or otherwise objectionable or inappropriate material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable local, state, national or international law;

b) Infringe or potentially infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party;

c) reference to or involves gambling, casinos, off-track betting, or other gambling of any form;

d) Consumption of alcohol, tabacco, or weaponry, or that promotes or has a connotation to any illegal activity;

e) impersonates, disguises or conceals any person or entity or otherwise misrepresents a Participant’s affiliation with a person or entity;

f) displays or depicts unacceptable clothing or adornments, or displays any commercial/corporate advertising (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements);

g) references persons or organizations without their written permission;

h) disparages persons or organizations associated with the Promoter; or

i) otherwise violates the standards of the Promoter as determined by Promoter in its sole discretion.

 

8. TAXES

Participants are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize(s). The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Participants are responsible for any and all expenses that they incur in entering the Promotion and they will not be reimbursed regardless of whether or not they win the Promotion.

 

9. PERSONAL DATA PROTECTION

9. GOVERNING LAW, DISPUTE RESOLUTION AND MISCELLANEOUS

This Promotion and any dispute arising from or in connection with it (including the Prizes) shall be governed by the laws of UAE and any dispute which cannot be settled amicably shall be submitted to the Courts of the Dubai International Financial Centre, unless otherwise provided for in mandatory legal provisions.

These Terms are written in English and may be translated into other languages. In the event of any inconsistency between the English version and a translated version of this notice, the English version shall prevail.

Nothing in these Rules shall affect Participants’ statutory rights. The invalidity, illegality or unenforceability of any sole provision in these Terms shall not affect the remaining provisions of these Terms, which shall persist in full effect.
